La ley jurídica preserva sorprendentemente un contenido de ínsita verdad y solidez, caracteres de los que aún la ley científica, siempre hipotética y provisoria, ya no presume. En el presente artículo se pretende esbozar un camino hacia la explicación de este anacronismo, a través de las modalidades asumidas por la ley para hacer regir las regularidades del mundo. La ley es una estrategia para controlar el espacio y eludir el tiempo. Cada época ha tenido sus formas de llevar a cabo (...) ese control / elusión, desde una certeza original que le sirva de ubicación y referencia. Los valores de la ley están relacionados con el residuo de cada una de las certezas originales sobre las que se instauró históricamente. A fin de obtener dichos fines, necesita tanto de la sedimentación de las sucesivas capas de venerabilidad, como del ahogo de la memoria y del tiempo y de la historia que las han concebido y desarrollado. La evaluación es un aspecto que predomina en la educación, pero que necesita ser repensada. Este artículo reflexiona sobre la noción de evaluación en la sociedad actual y propone una alternativa a lo que ella podría y debería ser. Como resultado de un estudio crítico del papel de la evaluación en la educación actual, decidimos llevar a cabo un análisis hermenéutico de la influencia del concepto original de evaluación en la posibilidad de alejarse de la tributación del sujeto y su (...) actual pornificación. A través de una discusión sobre el papel de la evaluación en la sociedad contemporánea y su verdadera naturaleza, los autores proponen un cambio de mirada sobre la evaluación como un mero complemento al plan de estudios a otra que considere cómo una filosofía de la evaluación podría transformar profundamente la educación y la sociedad. En el presente artículo se muestra que en la cosmología cartesiana no resulta claro cómo se puede hablar o referir a cuerpos individuales en el marco de un universo absolutamente compacto. Se defiende que el concepto de cuerpo individual en el interior de dicha cosmología se puede construir como una ficción del espíritu. Un cuerpo individual se puede construir como la extensión que se encuentra encerrada en una superficie maximal cuyas subdivisiones carecen de movimiento relativo entre sí. Desde fines de los 90, y siguiendo una década de severos planes de ajuste estructural, América Latina fue surcada por numerosas experiencias de revueltas populares. Estas revueltas trajeron consigo masivas manifestaciones colectivas, altos niveles de agresión física y verbal contra políticos, jueces y funcionarios públicos, en general. Las protestas incluyeron, por ejemplo, la organización de ¿piquetes¿ destinados a bloquear el tráfico en las rutas principales, con el objeto de exigir empleo, comida, o el otorgamiento de subsidios; tanto como ruidosas manifestaciones (...) (i.e., ¿cacerolazos¿). Estas agresiones a las autoridades públicas alcanzaron el domicilio y las propiedades de los últimos, tato como los edificios públicos en los que trabajaban (la sede del gobierno, las legislaturas, los tribunales). Entre otros resultados, dichas protestas forzaron la renuncia del presidente Raúl Cubas, en Paraguay, en 1999;la del presidente Alberto Fujimori, en Perú, en el 2000; la del presidente Jail Mahuuad, en Ecuador, en el 2000 (tanto como la remoción del presidente Abdala Bucaram, en 1996); la del presidente Sánchez de Lozada en Bolivia, en el 2002; y la del presidente Bertrand Aristide, en Haití, en el 2004. En la Argentina, estas protestas culminaron con una profunda crisis que incluyó el mandato de cinco presidentes distintos en menos de dos semanas. Por supuesto, esta manifestaciones fueron promovidas, en cada caso, a partir de circunstancias parcialmente diversas. Algunas fueron seguramente más legítimas que otras; algunas fueron más ¿espontáneas¿ o ¿genuinas¿ que otras; algunas resultaron más poderosas y duraderas que otras. De todos modos, la presencia de todas estas variaciones no deberían impedirnos que reconozcamos las similitudes que vincularon a estos acontecimientos, que aluden al tipo de crisis que se encuentra afectando a muchos órdenes legales contemporáneos. In his essay against Eberhard, Kant denies that there are innate concepts. Several scholars take Kant’s statement at face value. They claim that Kant did not endorse concept innatism, that the categories are not innate concepts, and that Kant’s views on innateness are significantly different from Leibniz’s. This paper takes issue with those claims. It argues that Kant’s views on the origin of the intellectual concepts are remarkably similar to Leibniz’s. Given two widespread notions of innateness, the dispositional notion and (...) the input/output notion, intellectual concepts are innate for Kant no less than for Leibniz. (shrink)

The nature of pre-reflective self-consciousness—viz., the putative non-inferential self-consciousness involved in unreflective experiences, has become the topic of considerable debate in recent analytic philosophy of consciousness, as it is commonly taken to be what makes conscious mental states first-personally given to its subject. A major issue of controversy in this debate concerns what pre-reflective self-consciousness is an awareness of. Some scholars have suggested that pre-reflective self-consciousness involves an awareness of the experiencing subject. This ‘egological view’ is opposed to the ‘non-egological (...) view’, according to which the subject, in being pre-reflectively self-conscious, is just aware of their own occurrent mental state. In this paper, I argue in favour of the egological view. The argument I develop is a qualified version of a line of reasoning originally provided by Rosenthal and builds on a proper clarification of the ontological status of token mental states. More precisely, I argue that token mental states are structured ‘fact-like’ entities having their subject among their constituents. Accordingly, one cannot be aware of one’s own occurrent mental state without thereby being aware of oneself. (shrink)

I argue that much philosophical discussion of moral disgust suffers from two ambiguities: first, it is not clear whether arguments for the moral authority of disgust apply to disgust as a consequence of moral evaluations or instead to disgust as a moralizing emotion; second, it is not clear whether the word ‘moral’ is used in a normative or in a descriptive sense. This lack of clarity generates confusion between ‘fittingness’ and ‘appropriateness’ of disgust. I formulate three conditions that arguments for (...) the moral authority of disgust need—but typically fail—to satisfy, in order to avoid (1) circularity, (2) the naturalistic fallacy, and (3) redundancy. These conditions are, respectively, (1) the identification of the direction of the causal relation between disgust and moral evaluation, (2) a demonstration that disgust is ‘fitting’ to morally relevant properties, and (3) a demonstration that disgust is ‘appropriate’ when elicited by these morally relevant properties. I will also suggest that, regardless of whether an argument for the moral authority of disgust can be made, it would be better to avoid the rather obscure term ‘moral disgust’. (shrink)

Between December 2020 and March 2021, the US Food and Drug Administration and the European Medicines Agency issued Emergency Use Authorizations and Conditional Marketing Authorizations for the distribution of the first COVID-19 vaccines. Although these vaccines were thoroughly assessed before their approval, regulators required companies to continue ongoing placebo-controlled clinical trials in order to gather further reliable scientific information on their safety and efficacy, as well as to start new studies to evaluate additional candidates. The aim of this paper is (...) to present and discuss the ethical issues raised by the tension between the need to continue these types of clinical trials and the obligations related to the protection of the rights and well-being of research participants. Specifically, we question whether—how, and to what extent—fundamental principles governing research involving human beings can be applied to the current pandemic situation. We argue that continuing ongoing placebo-controlled clinical trials can be considered ethically justifiable only if all participants are adequately informed of any developments that may affect their willingness to remain enrolled, including the current situation of resource scarcity and the prioritization criteria established for vaccination. However, we also argue that currently approved vaccines, which are considered safe and effective enough to be administered to millions of people as part of the vaccination campaign, necessarily represent the “best proven intervention” currently available and, therefore, should be used as comparators in future studies instead of placebo. This article addresses the power of human technologies to wreak destruction on a planetary scale, such as genetic manipulation and weapons of mass destruction. It proposes the need for a new ethic that would be planetary in scale. Its central aim would be to include the great historical and contemporary diversity of human cognitive and epistemological experience. An "ethic of complexity" can weave together the threads of our common heritage. Although humanity's evolutionary past has been shown to be quite diverse, (...) recent genetic and anthropological research has shown it also to be surprisingly unified. New images and metaphors are providing humanity with a vision that transcends familiar ethnic hatreds and so-called clashes of civilizations. The new planetary culture can be a shining example of unity-in-diversity, or unitas multiplex. It will be robustly diverse, intermixed to the core, and filled with awe at the rich lineages of our common past. (shrink)

This article looks at the prevalent view of time in the history of Western philosophy and science and then contrasts it with the emerging new vision of time as ontologically constructive. Throughout Western history, philosophers and scientists attempted to marginalize and anesthetize the role of time by prioritizing being over becoming. But beginning with the Darwinian revolution in biology, the West could no longer deny the constructive role of time in bringing forth new ontological orders. While the 20th century witnessed (...) the split between the reversible time of physics and the developmental time of biology, the time has now come for this divide to be reconciled. Twenty-first century science is already revealing the constructive role of time in cosmology with the likelihood of multiple universes. In conclusion, the authors speculate that our moment in human cultural development is ripe for a complex, multidimensional, and transdisciplinary understanding of time. (shrink)

El objetivo de este artículo es clarificar la noción de «vida auténtica» tal y como es descrita por Joan Roura-Parella en su última obra Tema y variaciones de la personalidad (1950). Por «vida auténtica» se entiende una vida autogobernada, que permite al individuo realizar su propia singularidad y, por tanto, preservar su autonomía y dignidad como persona. Una vida dominada por factores ajenos al propio individuo, sean cuales sean éstos, es una vida alienada, que no permite el desarrollo del individuo (...) en tanto la persona que es. Se señala la relevancia filosófica de la propuesta de Roura-Parella, que es la de ofrecer una justificación no-evidencial para una forma de vida cristiana, agapística. De acuerdo con Roura-Parella, una forma de vida basada en la entrega amorosa para con el prójimo está justificada en tanto que ésta es el resultado último de nuestra propia condición natural, constituyendo así un acto de afirmación personal y siendo, por tanto, condición necesaria para gozar de una vida auténtica — «la vida alcanza su hondo sentido al salirse de sí misma para darse a los demás» (Roura-Parella, Tema y variaciones de la personalidad, 1950, p. 229). Se señalan las diferencias y semejanzas de la propuesta de Roura-Parella con respecto a las de Miguel de Unamuno y Joaquim Xirau, autores que fueron cercanos a Roura-Parella y quienes, aunque partiendo de razonamientos distintos a los de Roura-Parella, también concibieron la entrega amorosa para con el prójimo como un acto de afirmación personal. With the pressing shortage of human organs and recent breakthroughs in gene editing, xenotransplantation—using animal organs, tissues or cells for human transplants—offers new hope for patients on wait lists. The use of genome editing technologies to produce xenotransplants from pigs with reduced immunogenicity has recently brought renewed attention to the field while also raising a host of ethical dilemmas. These concerns include animal welfare, the risks of zoonotic diseases, the moral implications of crossing species boundaries and the potential inequities in (...) access to such treatments. In their article ‘Who shall go first? A multicriteria approach to patient selection for first clinical trials of cardiac xenotransplantation’,1 Kögel and colleagues propose an ethical framework for selecting patients in cardiac xenotransplantation trials. They argue that while significant advances have been made with xenotransplants in brain-dead humans, limited knowledge can be gained from procedures performed outside clinical trials. According to them, knowledge production should be prioritised, and terminally ill patients who are unlikely to survive would not contribute meaningfully to scientific understanding or benefit from the procedure. That we can learn something from literature, as cognitivists claim, seems to be a commonplace. However, when one considers matters more deeply, it turns out to be a problematic claim. In this paper, by focusing on general revelatory facts about the world and the human spirit, I hold that the cognitivist claim can be vindicated if one takes it as follows. We do not learn such facts from literature, if by “literature” one means the truth-conditional contents that one may ascribe (...) to textual sentences in their fictional use, i.e., in the use in which one makes believe that things unfold in a certain way. What we improperly call learning from literature amounts to knowing actually true conversational implicatures concerning the above facts as meant by literary authors. So, in one and the same shot, we learn both a general revelatory fact and the fact that such a fact is meant via a true conversational implicature by an author. The author draws that implicature from the different truth-conditional content a sentence possesses when the sentence is interpreted in a fictional context, meant as Kaplan’s (1989) narrow context, i.e., a set of circumstantial parameters (agent, space, time, and world). Although the COVID-19 pandemic is a serious public health and economic emergency, and although effective vaccines are the best weapon we have against it, there are groups and individuals who oppose certain kinds of vaccines because of personal moral or religious reasons. The most widely discussed case has been that of certain religious groups that oppose research on COVID-19 vaccines that use cell lines linked to abortions and that object to receiving those vaccine because of their moral opposition to abortion. (...) However, moral opposition to COVID-19 vaccine research can be based on other considerations, both secular and religious. We argue that religious or personal moral objections to vaccine research are unethical and irresponsible, and in an important sense often irrational. They are unethical because of the risk of causing serious harm to other people for no valid reason; irresponsible because they run counter to individual and collective responsibilities to contribute to important public health goals; and in the case of certain kinds of religious opposition, they might be irrational because they are internally inconsistent. All in all, our argument translates into the rather uncontroversial claim that we should prioritize people’s lives over religious freedom in vaccine research and vaccination roll out. (shrink)

This paper claims that Heidegger’s confrontation with poetry and with Hegel’s end of art thesis can be read as an attempt to restore the highest function of art by deconstructing the ‘modern’ conception of truth underlying Hegel’s thesis. First, I discuss Heidegger’s interpretation of art following his assessment of the failure of metaphysical language to ‘unconceal’ the truth of Being. Second, I analyse, with specific reference to his interpretation of Hölderlin, what I reckon to be the core thread of Heidegger’s (...) philosophy of art, namely his antisubjectivism. Third, I turn to Hegel’s end of art thesis, showing how for him, as well as for Heidegger, the highest function of art is necessarily connected to antisubjectivism, and hence, under the conditions of modernity, is a thing of the past. Finally, I address Heidegger’s reference to Hegel’s thesis, and claim that, while Hegel fully remains within the horizon of modernity, thus affirming the irreversible pastness of art, Heidegger envisages the possibility of abandoning the fundamental orientation of modernity, and hence of revoking the thesis of the pastness of art. Michel Foucault and Roberto Esposito have been two of the most influential biopolitical thinkers of the twentieth century, but their respective approaches to the relationship between life and politics do not address the main problem of the Anthropocene: the relationship between life and energy. Thus, this article analyzes the biophysical limits of biopolitics in the works of Foucault and Roberto Esposito and, to overcome these limits, it proposes to analyze the physiological assembly of the devices of power within the energetic (...) flows of social metabolisms. The article concludes that the physio-political approach to human societies allows us to overcome the biophysical limits of both Foucauldian biopolitics and Esposito's immunological paradigm. Focusing especially on Science and the Modern World, this article explores Whitehead's understanding of the social contexts and repercussions of mathematical and scientific abstraction. It investigates his remarks on the need to offset pernicious practices of abstraction in the context of a renewed concern with the link between conceptuality and materiality in social theory. Whitehead's inquiry into the problematic legacy of Galileo and scientific materialism is then contrasted with a different diagnosis of the abstractive maladies of modern society, the one (...) put forward under the Marxist rubric of `real abstraction'. While both stances allow us to explore the social repercussions of abstractive practices, it is argued that an understanding of the practically abstract character of capitalism permits us to identify the limits of Whitehead's pedagogical wish to reform our culture of abstraction. El objetivo de este artículo es explorar la manera en que Joaquim Xirau y Miguel de Unamuno concibieron el amor. A pesar de que no hay motivos suficientes para concluir una influencia directa y filosóficamente relevante de Unamuno en la obra de Xirau, sí podemos concluir que la forma en que ambos autores concibieron el amor guarda ciertas similitudes. Así, ambos coinciden en concebir la entrega amorosa como un ejercicio de afirmación individual que trae consigo un incremento de la propia (...) singularidad. También, tanto Unamuno como Xirau conciben la entrega amorosa como un acto que, aun surgiendo del propio individuo y no de como es de hecho el mundo, personifica aquello amado, dejando de ser así visto como un mero objeto y mostrándose bajo una forma personal. Y ambos, aunque de un modo distinto, hacen del relato bíblico acerca de la vida y Resurrección de Cristo un aspecto central de sus maneras de entender el amor. (shrink)

Alireza Bagheri supports a policy on organ procurement where individuals could choose their own definition of death between two or more socially accepted alternatives. First, we claim that such a policy, without any criterion to distinguish accepted from acceptable definitions, easily leads to the slippery slope that Bagheri tries to avoid. Second, we suggest that a public discussion about the circumstances under which the dead donor rule could be violated is more productive of social trust than constantly moving the line (...) between life and death. The Covid-19 pandemic has further intensified a crisis in the functions and the perception of the state. It has also revealed underlying contradictions in both mainstream and radical ideologies of the state. A desire for the state as guarantor of public welfare vies with fear of the state’s hypertrophic capacities for surveillance and control. Following a brief exploration of the intimate modern connection between plagues and the state, the article tries to map some of the ways in which the state (...) has been at stake in political and theoretical commentaries on the pandemic. Is an epidemiological politics from below, beyond the plague state, possible? Can recent emergency measures be seen as incomplete or inverted anticipations of a communist use of the state of exception? Or is the primacy of the political we are currently experiencing a mere fetish, indissociable from the rule of capital? (shrink)

Cultural evolution researchers use transmission chain experiments to investigate which content is more likely to survive when transmitted from one individual to another. These experiments resemble oral storytelling, wherein individuals need to understand, memorize, and reproduce the content. However, prominent contemporary forms of cultural transmission—think an online sharing—only involve the willingness to transmit the content. Here I present two fully preregistered online experiments that explicitly investigated the differences between these two modalities of transmission. The first experiment (_N_ = 1,080 participants) (...) examined whether negative content, information eliciting disgust, and threat-related information were better transmitted than their neutral counterpart in a traditional transmission chain setup. The second experiment (_N_ = 1,200 participants) used the same material, but participants were asked whether or not they would share the content in two conditions: in a large anonymous social network or with their friends, in their favorite social network. Negative content was both better transmitted in transmission chain experiments and shared more than its neutral counterpart. Threat-related information was successful in transmission chain experiments but not when sharing, and finally, information eliciting disgust was not advantaged in either. Overall, the results present a composite picture, suggesting that the interactions between the specific content and the medium of transmission are important and, possibly, that content biases are stronger when memorization and reproduction are involved in the transmission—as in oral transmission—than when they are not—as in online sharing. Negative content seems to be reliably favored in both modalities of transmission. (shrink)

The issue as to whether an atomistic or holistic viewof knowledge and meaning is correct relies on the way part/whole relationships is analysed,exactly as the issue as to whether a constructive or realistic view of knowledge and meaningis correct relies on the way internal/external relationships is analysed. Both theprinciple of compositionality and the context principle depend on how finely the constituents,the nature and the size of the context are identified; both the notion of meaning andthe notion of truth depend on (...) the resources of internalisation/externalisation. Thus thespectrum of semantic and epistemological theories varies from (global) atomismto (global) holism, and from minimal to maximal internalisation. Are compositionaltheories necessarily extensional? Does formal semantics necessarily rely on set theory?Does the domain-specific character of the notions of element, part and whole prevent anygeneral, non-trivial account? The aim of the present paper is to provide a negative answerto these questions by exploring some of the features a theory covering the phenomenologyof part and whole should have. This phenomenology will only be sketched through a fewparadigmatic examples, showing how the reference of notions of part and wholevaries and which are the constraints inherentin such variation. Categorytheory provides the tools for fashioning this framework, since it allows describing any coherentcollection of objects (with actions defined over them) and (action preserving) maps betweenthe objects, as well as the variation of such collections in terms of suitablefunctors, coding the ways parts and wholes undergo co-variation.
